\u00a71 Conclusion of the Travel Contract<\/strong><\/p>\n

(1) By submitting the registration, the customer makes a binding offer to the tour operator SoulSurfcamp, LDA<\/em><\/strong> (hereinafter referred to as \u201cyou\u201d or \u201cthe tour operator\u201d) to enter into a travel contract.<\/p>\n

(2) The registration may be made in writing, orally, by fax, or electronically (email, internet). The registering customer is liable for the obligations of all other travelers listed in the registration under the travel contract, provided that the customer has assumed such liability through an explicit and separate declaration. <\/p>\n

(3) A travel contract is concluded upon acceptance by the tour operator <\/span>SoulSurfcamp, LDA. Acceptance by <\/span>SoulSurfcamp, LDA does not require any specific form. Upon or immediately after the conclusion of the contract, <\/span>SoulSurfcamp, LDA will send the customer a written travel confirmation.<\/p>\n

(4) If the content of the travel confirmation differs from the content of the registration, this constitutes a new offer from <\/span>SoulSurfcamp, LDA, to the <\/span>SoulSurfcamp, LDA, is bound by this offer for a period of 10 days. The travel contract is then concluded on the basis of this new offer if the customer accepts it within this period. The customer may accept the offer either expressly or by implied conduct, such as by making a down payment, paying the balance, or commencing the trip. <\/p>\n

\u00a72 Definition<\/p>\n

(1) For the purposes of these Terms and Conditions, \u201cconsumers\u201d are natural persons who enter into a business relationship with SoulSurfcamp, LDA, provided that such a relationship is not attributable to their commercial or self-employed professional activities.<\/p>\n

(2) For the purposes of these Terms and Conditions, \u201cbusiness entities\u201d are natural persons, legal entities, or partnerships with legal capacity that enter into a business relationship with the Agency in the course of their commercial or self-employed professional activities.<\/p>\n

(3) The organizer, as defined in these Terms and Conditions, is SoulSurfcamp, LDA.<\/p>\n

\u00a73 Payment<\/p>\n

(1) Payments toward the trip price prior to the end of the trip may only be made upon presentation of the security certificate as defined in \u00a7 651 k (3) of the German Civil Code (BGB). A deposit of 10% of the total trip cost is due immediately upon receipt of the trip confirmation. The deposit must be paid to the business account listed below at <\/span>SoulSurfcamp, LDA, and will be applied toward the total trip price. The deposit must be received in the business account within 14 days. <\/p>\n

(2) The balance of the trip price is due 14 days before the start of the trip and must be paid once it is confirmed that the trip will take place. The balance must be paid without being asked by <\/span>Payment must be received by SoulSurfcamp, LDA. The date on which the payment is credited to the tour operator\u2019s account shall determine whether the payment was made on time. <\/p>\n

(3) For last-minute bookings made less than two weeks before the start of the trip, the total trip price is due immediately upon receipt of the booking confirmation and must be paid to the tour operator.<\/p>\n

(4) Failure to make the down payment and\/or the balance shall have no effect on the validity of the travel contract. To the extent that <\/span>If SoulSurfcamp, LDA is ready and able to provide the service, the customer has no right to receive the travel service without full payment of the travel price. This does not apply to the customer\u2019s statutory or contractual rights of retention. <\/p>\n

(5) If the trip price remains unpaid despite being due and despite a deadline set by SoulSurfcamp, LDA, SoulSurfcamp, LDA may refuse to carry out the trip and charge the customer cancellation fees in accordance with Section 4.<\/p>\n

\u00a74 Services<\/p>\n

(1) The services agreed upon in the contract are set forth in the service descriptions in the brochure and\/or on the website of <\/span>SoulSurfcamp, LDA, and the related information in the travel confirmation. The information contained in the brochure or on the website is for <\/span>SoulSurfcamp, LDA binding.<\/p>\n

(2) SoulSurfcamp, LDA expressly reserves the right to amend the information contained in the brochure prior to the conclusion of the contract for objectively justified, substantial, and unforeseeable reasons; the customer will be informed of such changes before booking.<\/p>\n

(3) If a customized itinerary is prepared at the customer\u2019s request, the obligation to provide services arises exclusively from the specific offer made to the customer and the corresponding confirmation of registration.<\/p>\n

\u00a75 Withdrawal by the Customer\/Cancellations\/Rescheduling\/Substitutes<\/p>\n

(1) The customer may, at any time prior to the start of the trip, by providing notice to <\/span>SoulSurfcamp, LDA may cancel the travel contract. The date the tour operator receives the notice of cancellation is decisive. Customers are advised to submit their notice of cancellation in writing. <\/p>\n

(2) In the event of cancellation by the customer, SoulSurfcamp, LDA is entitled to lump-sum compensation, taking into account expenses that would normally have been saved and the possible alternative use of the travel services.<\/p>\n

(3) The following rates apply:<\/p>\n

For cancellations made up to 45 days before the start of the trip, a cancellation fee of 25.00 EUR per person will be charged.<\/p>\n

For last-minute cancellations, the following fees apply per person:<\/p>\n

\u2013 44th \u2013 31st day before the start of the trip: 10% of the total amount as stated in the booking confirmation,
\u2013 30th to 21st day before the start of the trip: 30% of the total amount as stated in the booking confirmation,
\u2013 20th to 11th day before the start of the trip: 40% of the total amount as stated in the booking confirmation, and
\u2013 starting on the 10th day before the start of the trip: 60% of the total amount as stated in the booking confirmation.<\/p>\n

Starting the day before the trip begins and in the event of a no-show, SoulSurfcamp, LDA will charge 80% of the total amount as stated in the guest\u2019s booking confirmation.<\/p>\n

If the remaining balance is not received by the deadline, the down payment will be considered a cancellation fee.<\/p>\n

(4) The customer is permitted to notify the tour operator <\/span>SoulSurfcamp, LDA must prove that it actually incurred no costs or costs lower than the flat-rate fee claimed. In this case, the customer is only obligated to pay the costs actually incurred. <\/p>\n

(5) SoulSurfcamp, LDA reserves the right, on a case-by-case basis, to charge a higher amount of compensation corresponding to the costs it has incurred, which must be specifically quantified and documented for the customer.<\/p>\n

(6) There is no legal right to changes regarding the travel dates, destination, accommodations, or meal plan (rescheduling). If rescheduling is carried out at the customer\u2019s request after the contract has been concluded, <\/span>SoulSurfcamp, LDA charges a rebooking fee of 50.00 EUR per change up to 30 days before the start of the trip. Requests for rebooking made after this deadline can, if at all possible, only be processed after canceling the travel contract under the above conditions and simultaneously submitting a new booking. This does not apply to rebooking requests that incur only minor costs. <\/p>\n

(7) If the customer is unable to take the trip, he or she may, up until the start of the trip, designate a substitute who will assume the rights and obligations under the travel contract in his or her place. The customer must notify the tour operator of the substitute in advance. The tour operator reserves the right to refuse this person if they do not meet the specific requirements of the trip, if their inclusion is not possible for organizational reasons, or if their participation is prohibited by law or official orders. The substitute who enters into the contract and the original customer are liable to the tour operator for the tour price and, as joint and several debtors, for all additional costs incurred as a result of the substitute\u2019s entry into the contract. <\/p>\n

(8) Additional rules during the COVID-19 pandemic:<\/p>\n

Our General Terms and Conditions continue to apply. Should <\/span>prior to arrival<\/strong> <\/span>the regulations governing travel to SoulSurfcamp change\u2014for example, in the form of travel restrictions for Portugal and\/or for the country of origin and\/or canceled and\/or rescheduled flights (and others)\u2014our regulations regarding cancellation of the stay, as summarized in \u00a75 of the General Terms and Conditions, will continue to apply. This provision applies to <\/span>all<\/strong> <\/span>changes and\/or cancellations resulting from and\/or caused by the COVID-19 pandemic prior to arrival at SoulSurfcamp Portugal.<\/p>\n

If a guest or group decides to leave early, <\/span>after the stay has already begun<\/strong> <\/span>\u2013 for example, if travel regulations change during the stay and\/or flights are rescheduled and\/or canceled (by the airline and\/or by the guest) \u2013 <\/span>SoulSurfcamp, LDA<\/em><\/strong> <\/span>the full cost of the stay as stated in the guest\u2019s booking confirmation (excluding training, rentals, and transfers). This policy applies to <\/span>all<\/strong> <\/span>changes and\/or cancellations that occurred and\/or were caused by the COVID-19 pandemic during the stay.<\/p>\n

It is up to <\/span>SoulSurfcamp, LDA<\/em><\/strong> <\/span>to decide whether to issue vouchers for the remaining balance. This decision is made solely by the owner and\/or her legal representatives. This policy applies only to trip cancellations due to the pandemic. <\/p>\n

\u00a76 Insurance<\/p>\n

SoulSurfcamp, LDA recommends purchasing travel cancellation insurance as well as international health insurance.<\/p>\n

\u00a77 Refunds for Unused Services During Normal Operations<\/p>\n

(1) If the customer does not make use of individual travel services (accommodation\/surf lessons\/rental\/transfer) due to an early return, <\/span>SoulSurfcamp, LDA<\/em><\/strong> <\/span>is not obligated to refund any payments already received. No refund will be issued by <\/span>SoulSurfcamp, LDA. If payment for the services that were agreed upon (verbally and\/or in writing) but not used has not yet been made, the guest is obligated to pay the outstanding amount. <\/p>\n

(2) If a guest does not make use of services booked in advance and\/or agreed upon verbally and\/or in writing during their stay, the guest is obligated to pay in full for the unused services. If payment for the services has already been made, there is no entitlement to a refund. No refund will be issued by <\/span>SoulSurfcamp, LDA. If the services have not yet been paid for, the guest is obligated to pay the full amount for the services. <\/p>\n

(3) Surf lessons, sessions, or private sessions that are canceled due to weather conditions (bad weather, poor conditions, etc.)\u2014where the decision regarding whether instruction can be conducted safely and effectively rests solely with <\/span>SoulSurfcamp, LDA<\/em><\/strong> <\/span>and its legal representatives\u2014will not be refunded. In this case, <\/span>SoulSurfcamp, LDA<\/em><\/strong> <\/span>will issue vouchers for the outstanding training sessions and provide these vouchers to the guest, which the guest can use during their next visit to SoulSurfcamp Portugal. No monetary refunds will be issued for canceled surf courses, sessions, or individual sessions. The same policy applies to equipment rentals. If the guest has not yet made payment, the guest is obligated to pay the outstanding balance. <\/p>\n

\u00a78 Withdrawal and Termination by the Tour Operator<\/p>\n

SoulSurfcamp, LDA may withdraw from the travel contract before the start of the trip or terminate the travel contract after the trip has begun in the following cases:<\/p>\n

    \n
  1. Without notice:<\/li>\n<\/ol>\n

    If the customer persistently disrupts the trip despite a warning from the tour operator, or if the customer acts in such a manner that is in breach of the contract to the extent that immediate termination of the contract is justified. The local representatives of <\/span>SoulSurfcamp, LDA are authorized in such cases to exercise the rights of <\/span>SoulSurfcamp, LDA<\/em><\/strong>. If <\/span>SoulSurfcamp, LDA, cancels the trip, it retains the right to the travel price; however, it must deduct the value of any savings it realizes from using the unused services for other purposes, including any amounts credited to it by service providers.<\/p>\n

      \n
    1. Up to two weeks before departure:<\/li>\n<\/ol>\n

      If the advertised or officially stipulated minimum number of participants is not reached, <\/span>SoulSurfcamp, LDA may withdraw from the travel contract if the travel brochure for the trip in question specifies a minimum number of participants. If, after SoulSurfcamp, LDA has exhausted all possibilities, it becomes unreasonable to carry out the trip <\/span>because the number of bookings for this trip is so low that, were the trip to take place, the resulting costs would exceed the economic threshold of sacrifice for this trip, the customer will be promptly refunded the trip price paid. The notice must be sent to the customer immediately after the conditions are met, and the travel price must be refunded immediately. <\/p>\n

        \n
      1. Up to 4 weeks before departure:<\/li>\n<\/ol>\n

        If, after exhausting all possibilities, it is not reasonable for <\/span>SoulSurfcamp, LDA to carry out the trip because the number of bookings for this trip is so low that doing so would require the tour operator to exceed the limit of economic sacrifice, the tour operator may cancel the trip. However, the right to cancel applies at this point only if <\/span>SoulSurfcamp, LDA is not responsible for the circumstances leading to the cancellation (e.g., no calculation errors), provides evidence of the circumstances leading to the cancellation, and has offered the customer a comparable alternative. If the trip is canceled for this reason, the customer will be promptly refunded the travel price already paid. In addition, the customer will be reimbursed for the cost of the booking if the customer does not accept an alternative offer from the tour operator. <\/p>\n

        \u00a79 Termination of the Contract Due to Extraordinary Circumstances<\/p>\n

        If the trip is significantly impeded, endangered, or disrupted as a result of force majeure that could not have been foreseen at the time the contract was concluded, both the tour operator and the customer may terminate the travel contract. If the contract is terminated, the tour operator may demand reasonable compensation for the travel services already provided or those still to be provided to complete the trip. <\/p>\n

        The tour operator is obligated to take the necessary measures, in particular\u2014if the contract includes return transportation\u2014to transport the customer back. Any additional costs incurred for the return transportation shall be borne equally by the parties. In all other cases, however, the additional costs shall be borne by the customer. <\/p>\n

        \u00a710 <\/strong>Obliegenheiten und K\u00fcndigung des Kunden, Gew\u00e4hrleistung, Ausschluss von Anspr\u00fcchen, Verj\u00e4hrung<\/strong><\/p>\n

        (1) F\u00fcr den Fall, dass die Reise nicht vertragsgem\u00e4\u00df erbracht wird, kann der Kunde Abhilfe verlangen. Der Reiseveranstalter <\/span>SoulSurfcamp, LDA <\/span><\/em><\/strong>kann die Abhilfe verweigern, wenn diese einen unverh\u00e4ltnism\u00e4\u00dfigen Aufwand erfordert. Der Reiseveranstalter kann auch in der Weise Abhilfe schaffen, dass er eine gleich- oder h\u00f6herwertige Ersatzleistung erbringt. Auftretende M\u00e4ngel sind stets unverz\u00fcglich der \u00f6rtlichen Reiseleitung oder unter der unten genannten Adresse\/Telefonnummer anzuzeigen. <\/p>\n

        (2) Wird eine Reise infolge eines Mangels erheblich beeintr\u00e4chtigt und leistet der Reiseveranstalter innerhalb einer angemessenen Frist keine Abhilfe, so kann der Kunde im Rahmen der gesetzlichen Bestimmungen den Reisevertrag k\u00fcndigen, wobei eine schriftliche Erkl\u00e4rung empfohlen wird.<\/p>\n

        (3) Die <\/span>SoulSurfcamp, LDA<\/em><\/strong> informiert \u00fcber die Pflicht des Kunden, einen aufgetretenen Mangel unverz\u00fcglich anzuzeigen, sowie dar\u00fcber, dass vor der K\u00fcndigung des Reisevertrages (\u00a7 651 e BGB) eine angemessene Frist zur Abhilfe-Leistung zu setzen ist, wenn die Abhilfe nicht unm\u00f6glich ist oder vom Reiseveranstalter verweigert wird, oder wenn die sofortige K\u00fcndigung durch ein besonderes Interesse gerechtfertigt ist. Der Kunde schuldet dem Reiseveranstalter den auf die in Anspruch genommenen Leistungen entfallenen Teil des Reisepreises, sofern diese Leistungen f\u00fcr ihn von Interesse waren. <\/p>\n

        (4) Bei Vorliegen einer nicht vertragsgem\u00e4\u00dfen Erbringung der Reise (Mangel), kann der Kunde unbeschadet der Herabsetzung des Reisepreises (Minderung) oder der K\u00fcndigung Schadensersatz verlangen, es sei denn, der Mangel beruht auf einem Umstand, den der Reiseveranstalter nicht zu vertreten hat.<\/p>\n

        (5) Reisevertragliche Gew\u00e4hrleistungsanspr\u00fcche sind innerhalb eines Monats nach der vertraglich vorgesehenen Beendigung der Reise gegen\u00fcber dem Reiseveranstalter unter der unten genannten Adresse von SoulSurfcamp, LDA<\/em><\/strong> geltend zu machen. Nach Ablauf dieser einmonatigen Frist kann der Kunde Anspr\u00fcche nur geltend machen, wenn er ohne Verschulden an der Einhaltung der Frist verhindert worden ist oder wenn es sich um deliktische Anspr\u00fcche handelt. Anspr\u00fcche des Kunden nach \u00a7\u00a7 651 c \u2013 651 f BGB gegen\u00fcber SoulSurfcamp, LDA<\/em><\/strong> verj\u00e4hren nach zwei Jahren. Die Verj\u00e4hrung beginnt mit dem Tag, an dem die Reise dem Vertrag nach enden sollte. Schweben zwischen dem Kunden und dem Reiseveranstalter Verhandlungen \u00fcber den Anspruch oder die den Anspruch begr\u00fcndenden Umst\u00e4nde, so ist die Verj\u00e4hrung gehemmt, bis der Kunde oder der Reiseveranstalter die Fortsetzung der Verhandlungen verweigert. <\/p>\n

        \u00a711 <\/strong>Mitwirkungspflicht<\/strong><\/p>\n

        Der Kunde ist verpflichtet, bei aufgetretenen Leistungsst\u00f6rungen im Rahmen der gesetzlichen Bestimmungen \u00fcber die Schadensminderungspflicht mitzuwirken, eventuelle Sch\u00e4den zu vermeiden oder m\u00f6glichst gering zu halten. Insbesondere ist der Kunde verpflichtet, seine Beanstandungen unverz\u00fcglich der \u00f6rtlichen Reiseleitung zur Kenntnis zu bringen. Unterl\u00e4sst es der Kunde schuldhaft, einen Mangel anzuzeigen, so tritt ein Anspruch auf Minderung nicht ein. <\/p>\n

        \u00a712 <\/strong>Haftung des Reiseveranstalters und Haftungsbegrenzung<\/strong><\/p>\n

        (1) Die vertragliche Haftung des Reiseveranstalters <\/span>SoulSurfcamp, LDA<\/em><\/strong> f\u00fcr Sch\u00e4den, die nicht K\u00f6rpersch\u00e4den sind, ist pro Reise und Kunden auf den dreifachen Reisepreis beschr\u00e4nkt,<\/p>\n

          \n
        1. a) soweit ein Schaden des Kunden weder vors\u00e4tzlich noch grob fahrl\u00e4ssig herbeigef\u00fchrt wird oder<\/li>\n<\/ol>\n
            \n
          1. b) soweit der Reiseveranstalter f\u00fcr einen Kunden entstehenden Schaden allein wegen eines Verschuldens eines Leistungstr\u00e4gers verantwortlich ist.<\/li>\n<\/ol>\n

            (2) F\u00fcr alle gegen den Reiseveranstalter gerichteten deliktischen Schadensersatzanspr\u00fcche, die nicht auf Vorsatz oder grober Fahrl\u00e4ssigkeit beruhen, haftet der Reiseveranstalter bei Sachsch\u00e4den bis \u20ac 4.100; \u00fcbersteigt der dreifache Reisepreis diese Summe, so ist die Haftung des Reiseveranstalters f\u00fcr Sachsch\u00e4den auf die H\u00f6he des dreifachen Reisepreises pro Reise und Kunde beschr\u00e4nkt.<\/p>\n

            (3) Die oben genannten Haftungsbeschr\u00e4nkungen gegen den Reiseveranstalter sind insoweit beschr\u00e4nkt oder ausgeschlossen, als aufgrund internationaler \u00dcbereinkommen oder auf solchen beruhenden gesetzlichen Vorschriften, die auf die vom Leistungstr\u00e4ger zu erbringenden Leistungen anzuwenden sind, einen Anspruch auf Schadenersatz gegen den Leistungstr\u00e4ger nur unter bestimmten Voraussetzungen oder Beschr\u00e4nkungen geltend gemacht werden kann oder unter bestimmten Bedingungen ausgeschlossen sind, darf sich der Reiseveranstalter gegen\u00fcber dem Kunden hierauf berufen.<\/p>\n

            \u00a713 <\/strong>Pass-, Visa- und Gesundheitsvorschriften<\/strong><\/p>\n

            (1) <\/span>SoulSurfcamp, LDA<\/em><\/strong> informiert den Kunden \u00fcber Bestimmungen von Pass-, Visa- und Gesundheitsvorschriften sowie deren eventuelle \u00c4nderungen vor Reiseantritt. Hierbei wird vorausgesetzt dass der Kunde Staatsb\u00fcrger der Bundesrepublik Deutschland ist. Andere Umst\u00e4nde k\u00f6nnen hierbei in der Person des Kunden nicht ber\u00fccksichtigt werden, au\u00dfer sie wurden <\/span>SoulSurfcamp, LDA<\/em><\/strong> ausdr\u00fccklich mitgeteilt.<\/p>\n

            (2) Insbesondere f\u00fcr die W\u00fcstenreisen nach Tunesien ben\u00f6tigt ein vollj\u00e4hriger Kunde einen Reisepass, der zum Zeitpunkt des Antritts der Reise noch mindestens 3 Monate g\u00fcltig sein muss. Kinder ben\u00f6tigen einen Kinderreisepass mit Lichtbild mit gleicher Mindestg\u00fcltigkeitsdauer. <\/p>\n

            (3) Der Kunde ist f\u00fcr die Einhaltung aller f\u00fcr die Durchf\u00fchrung der Reise wichtigen Vorschriften und Bestimmungen selbst verantwortlich. S\u00e4mtliche Nachteile, die aus der Nichtbeachtung dieser Vorschriften entstehen, gehen zu seinen Lasten, ausgenommen, der Reiseveranstalter hat seine Hinweispflichten verschuldet nicht erf\u00fcllt. <\/p>\n

            (4) \u00dcber die Zoll- und Devisenvorschriften hat sich der Kunde selbst zu informieren.<\/p>\n

            \u00a714 <\/strong>Preisanpassungen<\/strong><\/p>\n

            (1) <\/span>SoulSurfcamp, LDA<\/em><\/strong> beh\u00e4lt sich vor, den mit dem Reisevertrag vereinbarten Preis im Falle der Erh\u00f6hung der Bef\u00f6rderungskosten oder der Abgaben f\u00fcr bestimmte Leistungen, wie Hafen- oder Flughafen-Steuer oder einer \u00c4nderung der f\u00fcr die betreffende Reise geltenden Wechselkurse zu \u00e4ndern. Erh\u00f6hen sich die Bef\u00f6rderungskosten, insbesondere die Treibstoffkosten, so kann der Reisepreis nach Ma\u00dfgabe der nachfolgenden Berechnung erh\u00f6ht werden: <\/p>\n

              \n
            1. a) Bei einer auf den Sitzplatz bezogenen Erh\u00f6hung kann <\/span>SoulSurfcamp, LDA<\/em><\/strong> vom Kunden den Erh\u00f6hungsbetrag verlangen. In anderen F\u00e4llen werden die geforderten erh\u00f6hten Bef\u00f6rderungskosten durch die Zahl der Sitzpl\u00e4tze des vereinbarten Bef\u00f6rderungsmittels geteilt. Den sich so ergebenden Erh\u00f6hungsbetrag f\u00fcr den Einzelplatz kann vom Kunden verlangt werden. <\/li>\n<\/ol>\n
                \n
              1. b) Werden Abgaben wie Hafen- oder Flughafen-TAX gegen\u00fcber <\/span>SoulSurfcamp, LDA<\/em><\/strong> erh\u00f6ht, so kann der Reisepreis um den entsprechenden, anteiligen Betrag heraufgesetzt werden.<\/li>\n<\/ol>\n
                  \n
                1. c) Bei einer \u00c4nderung der Wechselkurse kann der Reisepreis in dem Umfang erh\u00f6ht werden, in dem sich die Reise dadurch f\u00fcr <\/span>SoulSurfcamp, LDA<\/em><\/strong> verteuert hat.<\/li>\n<\/ol>\n

                  (2) Eine Erh\u00f6hung des Reisepreises ist jedoch nur zul\u00e4ssig, sofern zwischen Vertragsschluss und dem vereinbarten Reisetermin mehr als 4 Monate liegen und die zur Erh\u00f6hung f\u00fchrenden Umst\u00e4nde vor Vertragsschluss noch nicht eingetreten und bei Vertragsschluss f\u00fcr <\/span>SoulSurfcamp, LDA<\/em><\/strong> nicht vorhersehbar waren.<\/p>\n

                  (3) Im Fall einer nachtr\u00e4glichen \u00c4nderung des Reisepreises oder einer nachtr\u00e4glichen \u00c4nderung einer wesentlichen Reiseleistung hat <\/span>SoulSurfcamp, LDA<\/em><\/strong> den Kunden unverz\u00fcglich davon in Kenntnis zu setzen. Eine Preiserh\u00f6hung, die ab dem 20. Tag vor dem vereinbarten Reisetermin verlangt wird, ist unwirksam. Bei Preiserh\u00f6hungen um mehr als 5% oder im Fall einer erheblichen \u00c4nderung einer wesentlichen Reiseleistung ist der Kunde berechtigt, ohne Kosten vom Reisevertrag zur\u00fcckzutreten oder die Teilnahme an einer mindestens gleichwertigen anderen Reise zu verlangen, wenn <\/span>SoulSurfcamp, LDA<\/em><\/strong> in der Lage ist, eine solche Reise ohne Mehrpreis f\u00fcr den Kunden aus dem eigenen Reiseangebot anzubieten.<\/p>\n

                  \u00a715 <\/strong>Datenschutz<\/strong><\/p>\n

                  (1) Dem Kunden ist bekannt und er willigt darin ein, dass die zur Abwicklung des Vertragsverh\u00e4ltnisses erforderlichen pers\u00f6nlichen Daten vom Reiseveranstalter auf Datentr\u00e4gern gespeichert und im Rahmen der Bestellabwicklung gegebenenfalls an verbundene Unternehmen weitergegeben werden. Der Kunde stimmt der Erhebung, Verarbeitung und Nutzung seiner personenbezogenen Daten ausdr\u00fccklich zu. <\/p>\n

                  (2) Die gespeicherten pers\u00f6nlichen Daten werden vom Kunden selbstverst\u00e4ndlich vertraulich behandelt. Zum Zwecke der Kreditpr\u00fcfung beh\u00e4lt sich der Reiseveranstalter einen Datenaustausch mit Auskunfteien vor. <\/p>\n

                  (3) Die Erhebung, Verarbeitung und Nutzung der personenbezogenen Daten erfolgt unter Beachtung des Bundesdatenschutzgesetzes (BDSG) sowie des Teledienstdatenschutzgesetzes (TDDSG).<\/p>\n

                  (4) Dem Kunden steht das Recht zu, seine Einwilligung jederzeit mit Wirkung f\u00fcr die Zukunft zu widerrufen. Der Reiseveranstalter ist in diesem Fall zur sofortigen L\u00f6schung der pers\u00f6nlichen Daten des K\u00e4ufers verpflichtet. Bei laufenden Nutzungsverh\u00e4ltnissen erfolgt die L\u00f6schung nach Beendigung des Vertrages. <\/p>\n

                  \u00a7<\/strong>16 <\/strong>Anwendbares Recht, Teilunwirksamkeit, Gerichtsstand<\/strong><\/p>\n

                  (1) Auf den Reisevertrag findet ausschlie\u00dflich deutsches Recht Anwendung.<\/p>\n

                  (2) Eine Unwirksamkeit einzelner Bestimmungen hat nicht die Unwirksamkeit des gesamten Reisevertrages zur Folge.<\/p>\n

                  (3) Der Reiseveranstalter <\/span>SoulSurfcamp, LDA<\/em><\/strong> kann an seinem Sitz verklagt werden. Der Reiseveranstalter kann den Kunden an dessen Wohnsitz verklagen. <\/p>\n
